Terms of Service

1. Acceptance

By accessing or using Grafics AI (grafics.ai, grafics.com), you agree to these terms. If you do not agree, do not use the service. These terms apply to all users including free, trial, and paid members.

2. The Service

Grafics AI provides AI-powered brand graphics generation. We offer a free tier with limited outputs and a paid Member plan ($39/month) with unlimited access. Features and pricing may change with 30 days notice to active subscribers.

3. Your Account

You must provide accurate information when creating an account.
You are responsible for maintaining the security of your account credentials.
One account per person. No sharing or reselling of accounts.
You must be 18 or older to use the service.

4. Acceptable Use

You may not use Grafics AI to create graphics that are illegal, defamatory, harassing, or infringing on third-party intellectual property. We reserve the right to suspend accounts that violate this policy without refund.

5. Your Content

You retain ownership of all brand assets you upload (logos, images, fonts). By uploading, you grant Grafics Media LLC a limited license to process your assets solely to deliver the service. We do not use your brand assets to train AI models.

6. AI-Generated Output

Graphics generated by the AI are yours to use commercially. We make no warranty that outputs are free from third-party IP claims. You are responsible for reviewing outputs before publication.

7. Billing and Cancellation

Paid plans are billed monthly via Stripe.
You may cancel at any time. Access continues until end of billing period.
No refunds for partial months.
Failed payments result in account downgrade to the free tier after a 7-day grace period.

8. Disclaimer of Warranties

The service is provided “as is” without warranties of any kind. We do not guarantee uptime, accuracy of AI outputs, or fitness for any particular purpose.

9. Limitation of Liability

Grafics Media LLC's total liability to you shall not exceed the amount you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Governing Law

These terms are governed by the laws of the State of Delaware, USA. Disputes shall be resolved by binding arbitration under AAA rules, not in court, except for claims under $10,000 which may be brought in small claims court.

11. Changes

We may update these terms. We will email active subscribers 30 days before material changes take effect. Continued use constitutes acceptance.
