Terms of Service

1. Acceptance
By accessing or using Grafics AI (grafics.ai, grafics.com), you agree to these terms. If you do not agree, do not use the service. These terms apply to all users including free, trial, and paid members.
2. The Service
Grafics AI provides AI-powered brand graphics generation. We offer a free tier with limited outputs and a paid Member plan ($49/month) with unlimited access. Studio features and related tools may be offered under these terms. Things we offer may change as the market evolves — see Changes below.
3. Your Account
- You must provide accurate information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- One account per person. No sharing or reselling of accounts.
- You must be 18 or older and have authority to accept these terms for yourself or the entity you represent.
4. Acceptable Use
You may not use Grafics AI to create graphics that are illegal, defamatory, harassing, or infringing on third-party intellectual property. We reserve the right to suspend accounts that violate this policy without refund.
5. Your Content
You retain ownership of all brand assets you upload (logos, images, fonts). By uploading, you grant Grafics Media LLC a limited license to process your assets solely to deliver the service. We do not use your brand assets to train AI models.
Listing photos and MLS use
You upload photos and listing facts. You warrant that you have the right to use them and that they accurately show the property. Grafics only corrects technical issues (exposure, white balance, straighten, crop, lens distortion, mild contrast, denoise, sharpen) and strips burned-in banners, watermarks, timestamps, and contact marks. We do not stage rooms, replace skies or lawns, add or remove structure, hide defects, or certify MLS compliance. FMLS, GAMLS, and other boards may reject files. You decide what to upload and you are responsible for those uploads and for any disclosure your board requires. If we cannot clean a file without guessing, we refuse that file or ask you to confirm.
You further warrant that you will comply with applicable FMLS rules (including no misrepresentation and no text burned onto MLS photos), GAMLS photo policy, the NAR Code of Ethics, and Georgia real estate license law, as they apply to you. Output from Grafics is not a representation that any board will accept the file.
6. AI-Generated Output
Graphics generated by the AI are yours to use commercially. We make no warranty that outputs are free from third-party IP claims. You are responsible for reviewing outputs before publication.
7. Billing and Cancellation
- Paid plans are billed monthly via Stripe.
- You may cancel at any time. Access continues until end of billing period.
- No refunds for partial months.
- Failed payments result in account downgrade to the free tier after a 7-day grace period.
8. Disclaimer of Warranties
The service is provided “as is” without warranties of any kind. We do not guarantee uptime, accuracy of AI outputs, or fitness for any particular purpose.
9. Limitation of Liability
Grafics Media LLC's total liability to you shall not exceed the amount you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
10. Governing Law
These terms are governed by the laws of the State of Delaware, USA. Disputes shall be resolved by binding arbitration under AAA rules, not in court, except for claims under $10,000 which may be brought in small claims court.
11. Indemnity
You agree to indemnify and hold harmless Grafics Media LLC from claims arising from your uploads, brand assets, MLS filings (where applicable), listing facts, or your misuse of outputs, including third-party and board claims.
12. Electronic notices
We may give notices by email to the address on your account or by posting in the product or on the site. Notices are effective when sent or posted. Where we email active subscribers about material changes, that is an additional courtesy notice.
13. Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control (including outages, MLS or carrier issues, natural disasters, labor disputes, or government action).
14. Changes; market evolution
Things we offer may change as the market evolves. Products, features, plans, pricing, trials, and channels may be added, changed, paused, or discontinued. We will update the “Last updated” date above when we change these terms. Continued use after an update constitutes acceptance. Price changes apply to new charges only — not to amounts already billed. Where practical, we may also email active subscribers before material changes take effect.
15. General
If a term is unenforceable, the rest remains in effect. These terms are the entire agreement between you and Grafics Media LLC for Grafics AI (together with any product-specific EULA you accept, such as MLS Ready). Failure to enforce a provision is not a waiver. You may not assign these terms without our consent; we may assign them in connection with a reorganization or sale.
